Breaking: Department of Education Opens Probe into Illegal Immigrant High School Student Accused of Groping Girls

At least a dozen female students in Fairfax County Public Schools have reported being groped by an illegal immigrant male student, prompting the Department of Education to launch a civil rights investigation into the district.
“ED is opening yet another investigation in Fairfax County following reports from 12 high school girls who have credibly accused one male student – an illegal immigrant – of sexual assault,” the Department of Education said in a statement on X. “This is the latest in a long list of investigations into Northern VA school divisions.”
The incident occurred at Fairfax County High School, according to 7News reporter Nick Minock. Israel Flores Ortiz, an 18-year-old eleventh grader, has been charged with nine counts of assault and battery following the girls’ accusations.
“It was all perpetrated by a single individual who is a stranger to the girls. He just sneakily walked up behind them and put his hand in between their legs,” a mother told 7News. “It was not just a butt smack or a butt grab. It was a groping of a private area. It had been occurring for several months.”
Ortiz asked to be released from jail, a request Judge Dipti Pidikiti-Smith denied Friday, even after Fairfax Commonwealth Attorney Steve Descano’s office agreed to the bail request. The judge, however, said released Ortiz on bail is not in the public’s best interest.
Virginia law allows all state residents to attend public schools at taxpayer expense until the age of 22 regardless of citizenship status.
Descano’s office previously faced criticism for releasing Abdul Jalloh after he was charged with stabbing Stephanie Minter to death at a Virginia bus stop earlier this year, the latest alleged crime on a lengthy rap sheet that includes more than 30 charges. Descano’s office, however, dropped more than half of the charges, which included violent offenses such as assault and rape.
According to court records, the incidents occurred at the end of February, and Ortiz was arrested March 7.
Around a week after Ortiz was arrested, Fairfax High School Principal Georgina Aye, sent an email to parents regarding the incidents.
“We are writing to share the news of the recent arrest of a student who was charged with inappropriately touching other students at school,” the email reads, according to 7News. “These incidents involved the student touching students' buttocks while they were transitioning in the hallways.”
Ortiz is from El Salvador and entered the United States in 2024, according to the Department of Homeland Security. He was released into the country under the Biden administration.
“This 19-year-old criminal illegal alien should NOT have been attending a Virginia high school and allowed to prey on innocent teenage girls. He now faces nine counts of assault and battery. This is yet another example of the Biden Administration's failed open border policies," DHS Deputy Assistant Secretary Lauren Bis said in a statement.
DHS called on “Fairfax County sanctuary politicians” to not release Ortiz back into the public. The department also criticized Democratic Virginia Governor Abigail Spanberger’s recent decision to end cooperation with Immigration and Customs Enforcement. Spanberger rescinded former Governor Glenn Youngkin's agreement with ICE as one of her first acts in office.
Under President Trump, the Department of Education has targeted northern Virginia schools over alleged serial violations of civil rights law.
In its statement, DOE said five separate Northern Virginia school districts that allow students to use bathrooms that accord with their gender identity, rather than their biological sex, have had reports of male students inappropriately touching female students.
“Many female students in the Divisions have reported that they avoid using the restroom at school because the policies make them feel unsafe and uncomfortable,” according to DOE.
“Virginia's experiment with radical gender ideology, race-based admissions systems, far-Left indoctrination, and unlawful discrimination has inflicted immeasurable harm on our students,” DOE said. “It must stop.”
